This raises an important legal question: can AI legally use a person’s voice or face?
The answer is not a simple yes or no. In most situations, the legal position depends on consent, purpose, manner of use, and impact of the use. If AI is used to copy or recreate a person’s identity without permission, the law may treat it as a violation of personality rights, privacy, dignity, reputation, or even as cheating and impersonation. Meaning of using a person’s voice or face through AI
When AI uses a person’s voice or face, it usually means one of the following:
- cloning a person’s voice so that new audio can be generated in that voice,
- creating a deepfake video using a person’s face,
- using facial likeness in an advertisement, video, app or platform,
- making a digital avatar that resembles a real person,
- recreating expressions, gestures, tone or speaking style in a way that clearly identifies that person.
In legal terms, this is not just the use of an image or sound. It is the use of identity attributes. A person is recognised not only by name, but also by face, voice, likeness and persona. Therefore, when AI copies these features, it may amount to use of that person’s identity itself.
Why the law treats voice and face seriously
A person’s face and voice are unique identifiers. They carry emotional, social and commercial significance. A face can suggest endorsement. A voice can create trust. A likeness can influence consumers. Because of this, unauthorised use can cause several kinds of harm.
First, it may make people believe that the person has supported, approved or promoted something. Second, it may damage reputation if the AI-generated material is offensive, false or misleading. Third, it may affect privacy, especially when the content is created without consent. Fourth, it may interfere with a person’s right to control how identity is used in public and commercial spaces.

At the same time, personality rights are not limited only to famous people. Even an ordinary individual has a legitimate interest in preventing misuse of identity, especially where dignity, privacy or deception is involved.

Copyright protects original works such as photographs, films, songs, scripts and recordings. It does not automatically protect a person’s face or identity as such. Therefore, even if copyright exists in a photograph or recording, a separate issue may still arise when a person’s likeness or voice is misused.
Trademark law may help when a name, signature, brand identifier or other distinctive commercial sign is registered or strongly associated with a person. This becomes relevant especially where celebrity identity functions as a brand.

Difference between celebrities and ordinary individuals
The legal discussion becomes more visible when celebrities are involved because their identity has market value. A celebrity’s voice or face can directly influence commercial decisions. Because of this, courts have shown willingness to protect celebrity identity against unauthorised use, including in situations involving modern digital misuse.
But the issue does not end there. Ordinary individuals also deserve protection. A non-celebrity may not have endorsement value in the commercial sense, but still has privacy, dignity and the right to prevent false impersonation. Deepfakes involving students, employees, private individuals or family members can be equally harmful, and in many cases even more damaging on a personal level.
Therefore, the law should not be understood as protecting only fame. It also protects personhood.

Consent is the central principle in this area. But in the AI era, consent must be understood carefully. It should answer questions such as:
- Was consent actually given?
- Was the person told that AI cloning or synthesis would happen?
- Was the consent limited to one use or many uses?
- Was the person informed of commercial exploitation?
- Can the content be edited, repurposed or resold?
- Is there a right to withdraw permission?
These questions matter because AI tools can endlessly reproduce and transform a person’s identity once the source data is collected. A casual recording or photograph can become the foundation for large-scale misuse. That is why a vague or blanket permission may not be enough in many situations.
Remedies available in such cases
If a person’s voice or face is used unlawfully through AI, several legal remedies may be considered.
Injunction
The most immediate remedy is to seek restraint on further publication, circulation, display or monetisation. In digital matters, speed is extremely important because fake content spreads fast.

The larger legal challenge
The law is still trying to catch up with AI. Earlier, misuse of identity usually needed professional editing or deliberate copying. Now, AI can produce highly realistic results at very low cost and high speed. This changes both the scale and the danger of misuse.
