Artificial Intelligence (AI) has emerged as one of the most influential technologies of the 21st century. From predictive algorithms in healthcare to automated decision-making in governance, AI has transformed the way individuals, businesses, and governments operate. However, the rapid adoption of AI also brings ethical dilemmas and serious concerns for human rights.

This article explores the intersection of AI, ethics, and human rights, focusing on algorithmic bias and fairness, AI and the right to privacy with reference to the Puttaswamy judgement, AI and freedom of expression, AI in surveillance and predictive policing, and global ethical frameworks such as those by OECD, UNESCO, and IEEE.

Algorithmic Bias and Fairness

Understanding Algorithmic Bias

Algorithmic bias refers to systematic errors in AI systems that lead to unfair or discriminatory outcomes. Since AI systems learn from historical data, they often inherit existing societal prejudices. For example, recruitment algorithms trained on biased data may favour male candidates over women. Similarly, facial recognition systems have shown higher error rates when identifying darker-skinned individuals compared to lighter-skinned ones.

Bias in AI is not always intentional. It can result from:

  • Skewed datasets that do not represent the entire population.
  • Flawed assumptions in model design.
  • Over-reliance on correlations instead of causal relationships.

Why Fairness Matters

Fairness in AI is a human rights issue because biased algorithms can deny individuals opportunities, resources, or dignity. For example:

  • Employment: AI-driven recruitment tools may exclude qualified candidates based on gender, caste, or disability.
  • Finance: Credit scoring systems may deny loans disproportionately to certain socio-economic groups.
  • Healthcare: Predictive models may fail to account for genetic or regional variations, leading to misdiagnosis.

Such unfair outcomes violate the principles of equality enshrined in Article 14 of the Indian Constitution and international human rights instruments like the Universal Declaration of Human Rights (UDHR).

Addressing Bias

To ensure fairness, AI developers and regulators must:

  • Use diverse and representative datasets.
  • Conduct bias audits regularly.
  • Implement explainable AI (XAI) to understand why an algorithm reached a certain decision.
  • Ensure human oversight in critical decision-making processes.

AI and the Right to Privacy: The Puttaswamy Judgement Analysis

Privacy as a Fundamental Right

The Supreme Court of India in Justice K.S. Puttaswamy (Retd.) v. Union of India (2017) recognised the right to privacy as a fundamental right under Article 21 of the Constitution. This landmark ruling laid the foundation for regulating AI in India, especially concerning data collection and processing.

AI and Data Privacy

AI thrives on data—personal, behavioural, biometric, and even sensitive categories like health records. However, the mass collection and processing of personal data pose significant threats:

  • Profiling: AI can create detailed profiles of individuals, predicting their behaviour, preferences, and vulnerabilities.
  • Surveillance: Governments and corporations can monitor citizens at an unprecedented scale.
  • Data Misuse: Sensitive information can be exploited for commercial or political manipulation.

Puttaswamy’s Relevance to AI

The Puttaswamy judgement emphasised three principles:

  1. Legality: Any restriction on privacy must be backed by law.
  2. Necessity: Restrictions must serve a legitimate state interest.
  3. Proportionality: The extent of restriction must be proportionate to the need.

Applied to AI, this means:

  • AI systems must operate under clear legal frameworks.
  • Data processing should be limited to specific purposes.
  • The intrusion into privacy must not outweigh the benefits.

Towards Data Protection

India’s Digital Personal Data Protection Act, 2023 is a step towards ensuring privacy in the AI era. However, strong enforcement mechanisms, transparency obligations, and accountability frameworks will be necessary to prevent misuse.

AI and Freedom of Expression

AI as a Gatekeeper of Speech

AI systems are increasingly used to moderate online content on platforms like Facebook, YouTube, and X (formerly Twitter). These algorithms decide which posts to promote, demote, or remove. While AI moderation helps in filtering harmful content such as hate speech or child abuse material, it raises concerns about freedom of expression.

Risks to Free Speech

  • Over-censorship: AI may wrongly flag satire, political criticism, or minority voices as “hate speech”.
  • Chilling Effect: Excessive moderation may discourage individuals from expressing their opinions.
  • Opaque Decision-Making: Users often do not know why their content was removed or suppressed.

In India, Article 19(1)(a) guarantees the right to freedom of speech and expression. However, reasonable restrictions exist under Article 19(2). AI moderation must strike a balance between removing harmful content and protecting legitimate expression.

Responsible Moderation

To safeguard free speech:

  • AI moderation must be transparent and accountable.
  • Appeals and grievance redressal mechanisms must be available.
  • Human moderators should review borderline cases to prevent wrongful censorship.

AI in Surveillance and Predictive Policing

Rise of AI Surveillance

Governments are increasingly using AI-based surveillance systems, such as facial recognition cameras and predictive policing tools. While these technologies aim to enhance security, they also raise serious human rights concerns.

Predictive Policing

Predictive policing uses AI to analyse crime data and predict where crimes are likely to occur or who might commit them. Although it promises efficiency, it risks reinforcing biases:

  • Communities already over-policed may face even greater scrutiny.
  • Marginalised groups may be unfairly targeted.
  • Errors in prediction may result in wrongful detentions.

Human Rights Concerns

  • Right to Privacy: Constant surveillance intrudes upon individuals’ private lives.
  • Right to Equality: Disproportionate targeting undermines equality before law.
  • Right to Dignity: Excessive monitoring can stigmatise entire communities.

For instance, the deployment of facial recognition in public places without explicit legal backing may contradict the Puttaswamy principles of necessity and proportionality.

The Need for Safeguards

To prevent abuse:

  • AI surveillance must be backed by legislation with strict safeguards.
  • Independent oversight bodies should review deployments.
  • Citizens must have the right to challenge surveillance practices.

Ethical AI Principles: OECD, UNESCO, and IEEE

OECD AI Principles

In 2019, the Organisation for Economic Co-operation and Development (OECD) adopted five key AI principles:

  1. Inclusive growth, sustainable development, and well-being.
  2. Human-centred values and fairness.
  3. Transparency and explainability.
  4. Robustness, security, and safety.
  5. Accountability.

These principles encourage governments and businesses to ensure AI benefits society as a whole.

UNESCO’s Ethical AI Recommendation

In 2021, UNESCO adopted the Recommendation on the Ethics of Artificial Intelligence, which is the first global standard-setting instrument on AI ethics. It emphasises:

  • Human rights and dignity.
  • Gender equality and non-discrimination.
  • Environmental sustainability.
  • Ethical impact assessments.

This framework aims to create a balance between technological progress and ethical responsibility.

IEEE’s Ethically Aligned Design

The Institute of Electrical and Electronics Engineers (IEEE) developed “Ethically Aligned Design”, which guides engineers in designing AI systems that:

  • Protect human rights.
  • Respect cultural diversity.
  • Promote accountability and transparency.

Together, these global frameworks highlight the need for human-centred AI development, ensuring that technology serves humanity without undermining fundamental rights.

India’s Way Forward

India, as one of the largest AI markets, must carefully integrate these ethical and legal principles. Some key steps include:

  • Comprehensive AI Regulation: A dedicated AI law or framework addressing bias, accountability, and human rights.
  • Ethics by Design: Embedding fairness, transparency, and privacy safeguards in AI development.
  • Public Awareness: Educating citizens about their rights in the AI era.
  • International Cooperation: Aligning with global standards while considering local socio-cultural contexts.

Conclusion

The relationship between AI, ethics, and human rights is complex and evolving. On the one hand, AI offers immense benefits in efficiency, innovation, and problem-solving. On the other, it carries risks of bias, privacy violations, suppression of free expression, and unchecked surveillance.

By drawing lessons from the Puttaswamy judgement, respecting freedom of expression, and following ethical frameworks such as OECD, UNESCO, and IEEE, India and the global community can ensure that AI development remains human-centred, rights-based, and ethically responsible.
