Understanding Online Privacy and Security in India

India’s Growing Digital Landscape
In the past decade, the number of online users in India has exploded which means that there is increased traffic on digital platforms in India. Access to reasonably priced smartphones means that more and more citizens are connecting to online services. Current figures suggest that there are more than 970 million internet users, which is just over 67% of the population. Increased online users also means that there is a greater risk of data breaches and fraud.
Indians spend an average of six hours a day online which includes the use of digital services for various daily activities such as work, entertainment, social interactions, and purchases of products and services. The increased importance and need for online privacy and a secure environment for users has become a top priority for digital service providers and also for the Indian Government.
What Is Being Done To Keep Indians Protected Online?
The Indian government realises that the growing number of online users creates a greater risk of security breaches and can make internet users vulnerable to being the victims of third parties that have managed to access sensitive user data and even financial information. So, what is being done to ensure that Indians can enjoy online activities in a safe environment?
Until 2023, there was no standalone law or framework to provide data protection to online users. There were different laws that had been established such as the Information Technology Act in 2000, Reasonable Security Practices and Procedure and Sensitive Personal Data or Information in 2011. Though these acts did have benefits, none of them provided the level of security that online users deserve and require to safely enjoy online activities.
The lack of a comprehensive policy to ensure the online privacy and security of Indian users was addressed In 2017 when there was a case brought before the Indian Supreme Court Justice K.S. Puttaswamy (Retd) v. Union of India Data privacy which upheld that privacy (article 21 Right to Life and Liberty of the Indian constitution) is a fundamental right for every citizen. As a result, in 2023, the Digital Personal Data Protection Act was finally passed, which is designed to protect the privacy and security of Indian online users.
How Indians Can Protect Themselves When Online
Data Protection is very important for Indians and they should understand the DPDP act which explains their rights in regards to consent, data access, and what information users are obligated to provide under this law. There are several ways the users can protect their sensitive information.
Users should always be wary of untrustworthy software or websites. If in doubt, do not use these websites or software, as they could be designed to harvest sensitive information without the user being aware that their information is being stolen.
It is important to verify the identity of the individuals or businesses with whom a user communicates and always use secure channels that feature end-to-end encryption. If something does seem suspicious, then individuals should block any further communications and report any suspicious activities.
Ensure that all sensitive data on personal devices is protected through encryption to protect it from theft or unauthorised access. If you think that someone may have tried to access your information then it is always a good idea to change passwords and ensure that passwords do not include user information such as birthdays etc.
Be wary of offers that seem too good to be true. Nefarious third parties have only one goal to steal information from innocent victims for the purpose of defrauding them. Never give out sensitive details such as bank account details or other sensitive information over the phone. If you receive an email that seems suspicious you should never open it as often there is code in email that can access your personal information without you even knowing it.
How Reputable Websites Ensure A Safe User Experience
One of the most important attributes that users look for when they visit websites and platforms is the assurance that they are visiting a site where they are able to enjoy a secure environment. Businesses have realised the importance of their users’ data protection and privacy and they are implementing measures to create seamless experiences that provide users with the assurance that their privacy and security are being protected. Any reputable website or platform will implement robust security features.
It is essential that users have access to secure transactions when using online platforms. E-commerce platforms have realised how important online security is to users and that safe payment methods are essential therefore there are many different systems that have been put in place to assure customers that their privacy, financial information, and sensitive details are being protected. These measures help create a sense of trust among customers and also protects the business from loss of reputation as well potential financial loss.
SSL (Secure Socket Layer) creates a wall between the customer’s browser and the website that they are visiting which adds an extra layer of protection. If an e-commerce website does not have this feature then it should not be used as there is a bigger risk of a breach of data and potential fraud.
Encryption is one of the most robust forms of protection for sensitive user information and financial information. It creates a code that ensures that no personal information can be accessed without a code that is unique to the user and is used by reputable payment systems such as ApplePay, Paypal, UPI, and Google Pay. If a user is not familiar with the payment system that is being used, they should verify that it uses encryption before engaging in any type of transaction or giving out personal details.
