The Legal Landscape of Online Gaming in India

In India, online gaming laws are a combination of central acts, state rules, and court decisions. In the middle of it all is the IT Act 2000, which covers digital activities but does not touch upon gaming directly. Under the Constitution, states have the authority to establish their own gaming laws. This means that the status of real-money gaming can vary significantly based on the state in which you reside.
Central and State Regulations
The Lotteries (Regulation) Act 1998 provides the framework for lotteries across India. It allows state governments to organize, regulate, and prohibit lotteries within their state. Some, like Kerala and West Bengal, do not allow any lotteries; others, such as Sikkim and Goa, permit the activity under severe restrictions. Online lottery platforms must also be approved by states and adhere to central rules in order to stay legal.
Games of Skill Versus Games of Chance
One of the key legal distinctions is between games of skill and games of chance. The Supreme Court has held that games of skill, as opposed to games of chance, can be exempt from those gambling bans. Cash-based skill games are legal, in the vast majority of cases, and may be played across the country. Pure games of chance, however, are frequently prohibited unless specifically allowed by a state law.
Regulation of Online Lottery Platforms
When it comes to the regulation of online lottery platforms, online lotteries are governed by the central Lotteries Act and individual state laws. Platforms will be required to have a license in the state they operate in. They must also protect themselves from fraud and give some of their ticket revenue to the state government. The regulation of online lottery sites is necessary for the state to make money and to protect players from scams.
IT Rules, Taxation & Way Forward
In April 2023, the Ministry of Electronics and Information Technology extended the IT (Rules Intermediary Guidelines and Digital Media Ethics Code) Rules to online gaming intermediaries. The rules explain what is meant by “online real money games” and establish due-diligence requirements for operators, such as verification of users and responsible gaming features. As per the Income Tax Act, 1961, winnings from any games are chargeable to tax at 30%. A more uniform approach to regulation and increased legal certainty may result from the industry’s growth.
