TLH Advocates & Solicitors Secures Favourable Order for Andhra Pradesh Industrial Infrastructure Corporation Ltd. Before NCLT, Ahmedabad

TLH Advocates & Solicitors successfully represented Andhra Pradesh Industrial Infrastructure Corporation Ltd. (APIIC) before the NCLT, Ahmedabad Bench in liquidation proceedings concerning about 32.23 acres of industrial land at Kakinada, Andhra Pradesh owned by APIIC which was sold in the Liquidation Sale of a Corporate Debtor/Allottee of the said land.
In a notable order dated 12 February 2026, the NCLT directed to issue clarification in a concluded sale under Liquidation and issued direction for issuance of a corrigendum Sale Certificate, clarifying that the auction purchaser acquires only such limited and disputed rights as were held by Corporate Debtor in the Kakinada land, with all questions of ownership, title and possession kept open before the appropriate forum.
The order effectively safeguards APIIC’s statutory and proprietary rights, ensuring that the liquidation process does not prejudice its resumption and ownership claims over the resumed industrial land.
