Aretha Alpha Represents JioStar India in Supreme Court Arbitration Appointment Matter

Aretha Alpha has represented JioStar India Private Limited in successfully obtaining the appointment of Justice S.C. Gupte, former Judge of the Bombay High Court, as the Sole Arbitrator by the Hon’ble Supreme Court of India in its dispute with Green Bean Sports Marketing.
The dispute arose in connection with a Media Rights Sub-License Agreement dated 30 March 2023, under which JioStar granted Green Bean Sports Marketing sub-licensed media rights for the Indian Premier League (IPL) for the 2023–2027 seasons exclusively in Bangladesh. The agreement was subsequently amended on 1 March 2024 and contained a cross-default clause and an arbitration clause providing for resolution of disputes by a sole arbitrator, with Mumbai as the seat and venue of arbitration.

JioStar alleged that Green Bean had defaulted on payments under a separate sub-licensing agreement dated 7 February 2023 concerning Premier League broadcasting rights. Relying on the cross-default provision, JioStar issued a termination notice and demand notice and subsequently invoked arbitration through a notice dated 1 December 2025, proposing Advocate Mikhail Behl as the arbitrator.
As Green Bean did not respond to the arbitration notice, JioStar approached the Hon’ble Supreme Court under Section 11(6) of the Arbitration and Conciliation Act, 1996, seeking appointment of an arbitrator.
A Bench comprising Chief Justice Surya Kant, Justice Joymalya Bagchi and Justice V. Mohana allowed the petition and appointed Justice S.C. Gupte as the Sole Arbitrator to adjudicate the disputes arising out of the Media Rights Sub-License Agreement and the subsequent amendment. The Court further confirmed Mumbai as the seat and venue of the arbitration and granted the arbitrator liberty to fix his own fees.
