About the Course on Arbitration & Dispute Resolution with Saraf and Partners

Arbitration in India is no longer an alternative to litigation. It is the primary mechanism through which complex commercial disputes are being resolved across sectors, across borders, and at the highest levels of practice.

Yet the gap between knowing arbitration law and practising it remains significant. Most law students and young lawyers can cite the Arbitration and Conciliation Act, 1996. Far fewer know how to draft an arbitration clause that holds up, invoke arbitration correctly, seek interim relief under Section 9 or Section 17, build an evidentiary record, or understand how an arbitral tribunal actually approaches procedure, submissions, and decision-making.

This course is built to bridge that gap.

Across 8 live sessions, participants will work through the full lifecycle of an arbitration from the architecture of Indian arbitration law and the drafting of arbitration agreements to the commencement of proceedings, evidence and written submissions, institution selection, the award, challenge under Section 34, enforcement, and international commercial arbitration. The course closes with a session on the arbitrator’s perspective and what it takes to build a practice in this space.

This is not a lecture series on the provisions of the Act. It is training in how arbitration is actually practised, argued, and resolved, taught by the Dispute Resolution & Arbitration Team at Saraf and Partners.

01 — The Architecture of Indian Arbitration

• Structure and framework of the Arbitration and Conciliation Act, 1996, including key amendments.
• Domestic arbitration vs international commercial arbitration: legal distinction and practical implications.
• Seat vs venue: jurisdiction and procedural consequences.
• Ad hoc vs institutional arbitration and how the choice affects proceedings.

02 — Drafting and Interpreting Arbitration Agreements

• Essential elements of an arbitration clause: seat, governing law, institution, language and tribunal composition.
• Interpreting defective or pathological arbitration clauses.
• Arbitrability: disputes that can and cannot be referred to arbitration in India.
• Multi-party and multi-contract disputes: joinder, consolidation and drafting considerations.

03 — Commencing Arbitration and Interim Relief

• Invocation of arbitration: notice requirements and commencement of proceedings.
• Appointment of arbitrators and the Section 11 mechanism.
• Section 9 proceedings: available interim relief and principles governing its grant.
• Section 17 relief before the arbitral tribunal and its relationship with court-ordered interim measures.

04 — Evidence, Written Submissions and Hearings

• Building and organising the evidentiary record: documents, correspondence and other supporting material.
• Pleadings and written submissions in arbitration: structure, factual narrative and legal arguments.
• Witness statements and expert evidence: purpose and use during proceedings.
• Oral hearings and cross-examination: role, preparation and strategic considerations.

05 — Institution Selection and Procedural Strategy

• Key considerations while choosing an arbitral institution: rules, costs, timelines and administrative support.
• Overview of major institutions relevant to Indian practice, including ICC, SIAC, LCIA and MCA.
• Procedural orders and case management: timelines, hearings and document production.
• Procedural strategy including bifurcation, confidentiality and management of complex disputes.

06 — The Award, Challenge and Enforcement

• Structure and requirements of an arbitral award.
• Section 34 proceedings: grounds and limitations on challenging an award.
• Patent illegality and public policy as grounds of challenge.
• Section 36: enforcement of domestic awards, stay applications and the effect of challenge proceedings.

07 — International Commercial Arbitration and Foreign Awards

• International commercial arbitration under the Indian arbitration framework.
• Governing law, procedural law and law of the seat in cross-border disputes.
• Recognition and enforcement of foreign awards in India under Part II and the New York Convention.
• Cross-border arbitration strategy and key considerations for Indian parties.

08 — The Arbitrator’s Perspective and Building a Practice in Arbitration

• Appointment of arbitration: party nomination, institutional appointment and tribunal constitution.
• Independence, impartiality, disclosures and challenges to arbitrators.
• How arbitral tribunal approach procedure, evidence, submissions and decision-making.
