Canada sits near the top of the list for Indian law graduates who decide their legal career will happen somewhere other than India. However, the hard part is not the visa; it’s the quiet, largely self-directed business of getting a foreign law degree recognised — and the exams waiting at the end of it.

What follows is drawn from the National Committee on Accreditation’s own published material and, for the Ontario section, from the Law Society of Ontario. Requirements, fees and timelines do change, so treat this as an orientation and check the current position on the official sites before you rely on any of it.

What the NCA is

The National Committee on Accreditation (NCA) operates under the Federation of Law Societies of Canada. It assesses the legal education and experience of people who want to enter law society bar admissions in Canadian common law jurisdictions, and then assigns whatever further education is needed so that your knowledge of Canadian law is comparable to that of a graduate of an approved Canadian common law program.

The end product is a Certificate of Qualification. That certificate is not a licence to practise. It is what allows you to apply to a bar admission program in a Canadian common law jurisdiction — every province and territory except Quebec, which runs its own process.

Step one: the assessment

The NCA describes its process in five steps: you submit an application with the right documentation and payment; the NCA assesses your legal education and experience against the National Requirement; the NCA tells you what you must do, which it calls your assignments; you complete those assignments; and the NCA issues your Certificate of Qualification.

Documents are important here. Official documents generally have to be sent to the NCA directly by the issuing institution rather than by you, and if you’ve been called to the bar elsewhere, the admitting body will need to confirm that separately.

There is also a language step. Unless you are exempted, every applicant must complete a language competency screening test in English or French before their qualifications are assessed. The cost of the screening is included in the assessment fee.

Step two: your assignments

You can meet your assignments in one of three ways: by writing and passing NCA exams, by completing the assigned subjects at a Canadian law school, or by a combination of the two. In some cases the NCA will require the law school route.

The NCA generally assigns these five core common law subjects to all applicants:

  • Foundations of Canadian Law
  • Canadian Constitutional Law
  • Canadian Criminal Law
  • Canadian Administrative Law
  • Canadian Professional Responsibility

Two further requirements catch people out because they are not exams. If your qualifications are assessed after 1 January 2022, you must also complete a course in legal research and writing, either through an approved Canadian common law program or through the NCA’s legal research and writing module with the Canadian Centre for Professional Legal Education (CPLED). Separately, all NCA applicants must demonstrate competence in Indigenous Law and Peoples, through a CPLED module or an NCA-approved course at a recognised Canadian law school.

You have five years from the date your assessment was issued to complete your assignments, with extensions available on request.

When you get more than the core five

Two things commonly add subjects to an Indian graduate’s list.

The first is currency. Your qualifications are treated as current if, in three of the last five years, you have been attending a qualifying law degree program, pursuing additional legal studies, acquiring legal experience satisfactory to the Executive Director, or some combination of those. If they are not current, the NCA assigns one of Contracts, Torts or Property for each five-year period without current qualifications, up to fifteen years; where those are already assigned, further subjects are drawn from Business Organizations, Civil Procedure and Commercial Law. Beyond fifteen years, the Executive Director will require a year of in-person instruction.

The second is academic performance, and the NCA is blunt about it. Applicants from India and other Commonwealth countries who hold Third Class or lower standing should not expect to receive any recognition for the degree at all. Weak marks in individual core subjects can also mean more exams.

Step three: the exams

NCA exams are online, open book and fact-based, and the NCA compares them to Canadian law school exams. You get a maximum of three hours, and if you finish early you stay in place with your computer locked down for the full three hours.

You study alone. The NCA is explicit that you prepare without its help and that you are responsible for obtaining your own study materials. What it does publish is an exam outline, or syllabus, for each subject, which can be revised without notice and should be re-checked at registration; a sample exam per subject; a practice exam that lets you try the online platform; and two guides, How to Answer Fact-based Law Exam Questions and Tips for Writing NCA Torts Exam.

Exams are graded pass or fail, with 50 percent counting as a pass, and results are released roughly ten to twelve weeks after the last exam in a session. You can spread your exams across several sessions if you prefer.

Notice what is missing from that list. Outlines and sample questions tell you what will be asked. Nothing tells you whether the answers you write are good enough. Most candidates prepare for months without a single answer of theirs being read by anyone who knows the standard, and then wait another ten to twelve weeks to find out.

The skill that carries the marks

Open book sounds like a concession, but it removes the easiest way to earn marks. Every candidate walks in with the same statutes, cases and notes, so copying the law out of your materials proves nothing an examiner needs to see. The marks sit in what you do next: identifying the issues buried in the fact pattern, stating the Canadian rule that governs each one, applying that rule to these particular facts, and reaching a conclusion. Accurate doctrine that never touches the fact pattern scores poorly, and candidates who spend the three hours hunting through their materials tend to run out of time.

That is a writing habit rather than a reading habit, which means it is built by producing timed answers and having them assessed. This is also where self-study runs out of road. The NCA publishes exam outlines and a sample exam for each subject, but nobody marks the answers you write, so a great many candidates sit their first properly assessed paper on exam day itself. Money and time

The assessment fee is $400 CAD plus applicable taxes, and each exam registration is $500 CAD plus taxes, with the NCA putting the minimum cost of the exam route at roughly $3,000 plus taxes. The law school route is a different order of magnitude: the NCA estimates $35,000 to $56,000 in tuition for a full year’s enrolment.

On timing, the NCA gives a best-case scenario of about ten months and an average time to completion of about two years — and that is only to the certificate. In Ontario, licensing after that takes on average a further eighteen to twenty-four months.

Step four: after the certificate

With the certificate in hand you apply to a law society. Taking Ontario as the example, candidates must pass the barrister and solicitor licensing examinations, satisfy the good character requirement, and complete experiential training through either the Articling Program or the Law Practice Program. Candidates with at least ten months of common law practice experience may qualify for an exemption from experiential training, and those licensed elsewhere may qualify for an abridgment of their articling term — which is worth investigating early if you practised in India. Other provinces and territories run their own programs with their own rules, so check the law society where you actually intend to practise.

The NCA route mostly tests whether you can produce a competent, structured legal answer about unfamiliar law, under time pressure, with nobody checking your work along the way. Plan for that from week one and it becomes a manageable project.
