Eligibility

A. EDUCATIONAL – Degree in Law from a recognized University or equivalent.

B. EXPERIENCE – He should have been a member of a State Judicial Service for not less than seven years, or have held a superior post in the legal department of a State for not less than seven years, or have been a Central Government servant with at least seven years’ experience in legal affairs, or possess a Master’s Degree in Law with not less than five years’ teaching or research experience in Law, or be a qualified legal practitioner with not less than 30 years of practice.

Note:
I) The term ‘qualified legal practitioner’, in relation to appointment to a duty post in Grade IV by direct recruitment, means an advocate or a pleader who has practiced for at least seven years, or an attorney of the High Court of Bombay or Calcutta who has practiced as such for at least five years, or has practiced as both attorney and advocate for a total period of at least five years.

II) A ‘superior post’ in the legal department of a State means a post in the State Government that is not clerical in nature and requires a Law Degree for appointment.

III) In computing the period during which a person has held any office in the State Judicial Service, in the Legal Department of a State, or under the Central Government, any period spent in holding any of the aforesaid offices, or in legal practice, shall also be included.

IV) In computing the period during which a person has been a qualified legal practitioner, any period spent in the State Judicial Service, in a superior post in the legal department of a State, or as a Central Government servant with experience in legal affairs shall also be included.

V) The term “legal affairs” has a broad meaning and may include the following:
a) Providing legal advice on all matters, including conveyancing.
b) Conducting court cases and appearing in courts as Government Pleader or Public Prosecutor. Mere drafting of pleadings without legal input will not qualify as conduct of court cases.

The term “legal affairs” does not have a statutory definition. However, it generally covers all matters relating to law and the conduct of litigation in courts or quasi-judicial forums. Moreover, for recruitment to a post in legal affairs in the Central Government, a Law Degree is a prerequisite and essential qualification, in addition to post-qualification experience. Experience in legal affairs in the Central Government shall mean discharge of duties relating to legal affairs, requiring a Law Degree (LL.B).

VI) Post-qualification experience should be reckoned with reference to the minimum prescribed qualification. If the prescribed qualification is LL.B, then post-LL.B experience should be considered. If it is LL.M, then post-LL.M experience should be considered.

Responsibilities

  • to give advice on all matters referred by the various Ministries/Departments of the Government of India.
  • to look after Government litigation work.
  • to conduct court cases and to appear in courts on behalf of the Central Government, wherever required and
  • to perform administrative and other works as may be assigned.

Location

 New Delhi/Mumbai/Kolkata/Chennai/Bengaluru. Liable to serve anywhere in India.

Pay Scale

As per 7th CPC- Level-11 ( Rs.67,700-2,08,700) in Pay Matrix (Total emoluments excluding HRA&TA at the time of initial appointment will be Rs.67,700 plus DA as applicable per month)
