About the Opportunity

Every trademark filing begins with a single question: is this mark available, and is it defensible? The answer to that question is a trademark search advisory and it is one of the most billable, most respected, and most frequently outsourced deliverables in Indian IP practice.

Yet most law students encounter Section 9 and Section 11 of the Trade Marks Act, 1999 only as bare provisions to be reproduced in an examination answer. They are almost never taught what these sections actually are in practice: the two filters through which every single search result must be passed before a lawyer can tell a client to invest a brand, a budget, and a business identity into a mark.

A weak search leads to an examination report, an opposition, a rectification petition, or worse, a rebranding exercise after the client has already printed packaging. A strong, structured, well-documented search advisory prevents all of it.

JurisGo is organising a Free Master Session to take participants through the complete trademark search workflow, exactly as it is performed in practice, from the first search string to the final signed opinion.

This Master Session will focus on:

  • Section 9 – Absolute Grounds: the distinctiveness spectrum from generic to fanciful, descriptive and laudatory marks, marks indicating kind, quality, quantity or geographical origin, deceptive and scandalous marks, and how acquired distinctiveness under the proviso can rescue an otherwise weak mark
  • Section 11 – Relative Grounds: identity and deceptive similarity, similarity of goods and services, likelihood of confusion and likelihood of association, cross-class conflicts under the NICE Classification, and the special protection available to well-known marks
  • Common Law Searches: why the Register is only half the picture, prior user rights under Section 34, passing off exposure, and how to search MCA/ROC records, domain and WHOIS databases, GST listings, e-commerce marketplaces, app stores, social media handles and trade directories
  • Search Strings: the real craft of the search, Boolean logic, wildcards and truncation, prefix–suffix variation, vowel substitution, phonetic and transliteration equivalents, splitting composite and device marks, and building a search string matrix that survives scrutiny
  • The TMO Website: live, screen-shared navigation of the Trade Marks Registry portal, Wordmark search using Start With, Contains and Match With, Phonetic search, Vienna Code search for device marks, Public Search, the Trade Marks Journal, status tracking and the e-Register
  • Converting research into advice: structuring the search report, risk grading marks as High, Medium or Low, framing recommendations, drafting protective disclaimers, and communicating an adverse finding to a client who is already in love with the name
