About The Competition
This Judgement Writing Competition organised by the Centre for Business Laws, NUSRL Ranchi aims to cultivate sound legal reasoning, analytical thinking, and precision in judicial writing. Participants will assume the role of a judge, apply legal principles to given fact situations, and draft a well‑reasoned judgment. The competition simulates real‑world judicial decision‑making and strengthens participants’ understanding of procedural laws and judgment structuring.
Theme Of The Problem
An examination of creditor democracy, asset characterization, and judicial limits on commercial wisdom under the Insolvency and Bankruptcy Code, 2016.
The proposition explores the interplay between value maximisation, creditor democracy, and judicial oversight under the Insolvency and Bankruptcy Code, 2016 in a stalled real estate insolvency involving homebuyers, financial institutions, and a statutory authority. The problem raises issues regarding development rights as insolvency assets, constitution of the Committee of Creditors in cases involving related parties and assignment of debt, and the impact of procedural irregularities on the validity of a resolution plan.
