  • Basic Structure doctrine – Arts. 13 and 368
  • Right to Equality (Articles 14-18)
  • Right to Freedom (Articles 19-22)
  • Right Against Exploitation (Articles 23-24)
  • Right to Freedom of Religion (Articles 25-28)
  • Educational and Cultural Rights (Articles 29-30)
  • Right to Constitutional Remedies under Articles 32 and 226​: Types of writs: Habeas Corpus, Mandamus, Prohibition, Certiorari, Quo Warranto​

  • Nature, Scope and Extent of Executive Power of the Union and States 
  • Role of Prime Minister and Council of Ministers
  • Scope and Extent of Judicial Review of Executive Actions
  • Essential Conditions for promulgation of an Ordinance: ‘Ordinance’ under Article 13; Validity of Successive Promulgation of the same Ordinance (Articles 123, 213)
  • Pardoning Powers of President and Governor

Module 6: The Legislative Branch

  • Composition and functioning of Parliament: Lok Sabha and Rajya Sabha​
  • Qualification/Disqualification of Members (Article 84, Article 102)
  • Legislative Privilege

Module 7: The Judicial Branch

  • Union and State Judiciary; Supreme Court of India (Articles 124-147) – Composition, Appointment and Removal of Judges of Supreme court (Articles 124-130)
  • The High Court in the States; Appointment, Removal and Transfer of Judges;
  • Jurisdiction of Supreme Court – Original Exclusive (Articles 71, 131), Original Concurrent Jurisdiction of Supreme Court and High Courts (Article 32 read with Article 226);

Module 8: Distribution of Legislative Powers

  • Doctrine of Territorial Nexus (Article 245);

  • Residuary Power of Legislation (Article 248);
  • Parliament’s Power to Legislate on State subject matter– Articles 246 (4), 247, 249 – 253, 352, 356;
  • Doctrine of Repugnancy (Article 254);

Module 9: Administrative and Financial Relations

  • Distribution of Executive Powers (Art. 256 to 263);
  • Centre-State Administrative Co-ordination;
  • Concept of Trade and Commerce: GST

Module 10: Emergency Provisions

  • Proclamation of Emergency on the grounds of war, external aggression, and armed rebellion (Articles 352, 358, 359);
  • Power of Union Executive to issue directions (e.g., Articles 256, 257) and the effect of non-compliance (Article 365);
  • Duty of the Union to protect the States against external aggression and internal disturbance (Article 355);
  • Imposition of President’s Rule in States – Grounds, Limitations, Parliamentary Control, Judicial Review (Articles 356-357);
  • Financial Emergency (Article 360).

Certification

Participants who successfully complete the course requirements, including assessments and assignments, will be awarded a certificate of completion in “Indian Constitutional Law” issued by Into Legal World.
