Week 1: Introduction to Environmental Law and Policy
Lecture 1: Basics of Environmental Law
- Understanding the concept of environmental law.
- Constitutional provisions related to the environment.
- Role of writ jurisdiction and public interest litigations.
Lecture 2: Environmental Crimes and Legal Provisions
- Overview of environmental crimes.
- Relevant provisions from the Indian Penal Code (IPC) and Criminal Procedure Code (CrPC).
- National Environmental Policy 2006
- Understanding the policy framework.
- Goals, objectives, and implementation strategies.
Week 2: Law of Torts and Environment-Related Legislations
Lecture 3: Environment (Protection) Act, 1986
- Premises, objectives, and scope of the Act.
- Definitions and powers of the Central Government.
- Court powers, prevention of environmental pollution, and penalties.
Lecture 4: Factories (Amendment) Act, 1987 and Public Liability Insurance Act, 1991
- Key provisions from these Acts.
- Civil liability and compensation.
Week 3: Waste Management and Pollution Control
Lecture 5: Role of the Central Pollution Control Board (CPCB)
- Functions and responsibilities of CPCB.
- State Pollution Control Boards (SPCBs) and their roles.
- Waste management regulations and guidelines.
Lecture 6: International Environmental Laws and Case Studies
- Sovereignty and Responsibility: Balancing sovereign rights with environmental protection.
- Principle of Good Neighborliness and International Cooperation.
- Precautionary Principle: Addressing risks even in the absence of conclusive evidence.
- Principle of Common but Differentiated Responsibility: Recognizing varying responsibilities among nations.
- The Principle of Sustainable Development: Balancing environmental and developmental goals.
- Polluter Pays Principle: Holding polluters accountable.
- Ecocentrism: Focusing on the environment’s intrinsic value.
Week 4: Review and Application
Lecture 7: Case Studies and Legal Strategies
- Analysing landmark environmental cases.
- Legal strategies for environmental protection.
Lecture 8: National Green Tribunal (Drafting/Practical)
- Introduction to NGT: Overview of the National Green Tribunal, its composition, powers, and jurisdiction.
- Filing a Case: A step-by-step guide on how to file a case in the NGT, including necessary documents and forms.
- Drafting the Petition: Detailed instructions on drafting the petition, including essential elements and format.
- Evidence and Affidavits: Guidelines on preparing and submitting evidence and affidavits in support of the petition.
- Hearings and Procedures: Explanation of the hearing process, including how to present arguments and respond to counter-arguments.
